Redirection of Support
(1)
“Redirect” or “redirection of support” means:(a)
The process of distributing support that would otherwise be paid to the judgment creditor to a person who has physical custody of one or more minor children covered by a child support order; or(b)
The process of distributing to the obligee any support that would otherwise be paid to a child attending school pursuant to OAR 137-055-5110 (Child Attending School)(5)(b).(2)
The administrator may redirect support to a person with physical custody of one or more minor children covered by a child support order under the following circumstances:(a)
The judgment creditor submits a notarized authorization for support to be redirected to a person with physical custody of one or more minor children covered by a child support order; or(b)
The administrator has joined a person with physical custody of one or more minor children to a child support order pursuant to OAR 137-055-3500 (Joinder of a New Party to a Child Support Proceeding) and the order is not being modified.(3)
If the order is a class order as defined in OAR 137-055-1020 (Child Support Program Definitions)(7) and current support is redirected under this rule for less than all of the children for whom support is ordered, the administrator will determine the amount of support to attribute to each child by dividing the monthly support amount by the number of children for whom support is ordered.
