Consultation with Legal Counsel

(1)

The purpose of this rule is to provide guidance to governing bodies when the governing body holds an executive session permitted by ORS 192.660 (Executive sessions permitted on certain matters)(2)(h): “To consult with counsel concerning the legal rights and duties of a public body with regard to current litigation or litigation likely to be filed.”

In order to meet the requirements for an executive session permitted by ORS 192.660 (Executive sessions permitted on certain matters)(2)(h), the attorney with whom the governing body is consulting must be present at the executive session, either in person or by telephone or by other concurrent means of oral or video electronic communication.
