Postponement


(1)

The Hearings Officer may postpone a revocation hearing for good cause and for a reasonable period of time.

(2)

The criteria for “good cause” includes, but is not limited to:

(a)

The preparation of defense;

(b)

Illness or unavailability of the AIC on leave or other persons;

(c)

Gathering of additional evidence; or

(d)

Avoiding interference with an ongoing police investigation or pending prosecution.

(3)

The Hearings Officer may make a finding of a violation and defer disposition for a reasonable time if such delay is reasonably necessary for the AIC or Hearings Officer to obtain information relevant to disposition decision.
