Facilities certified under the 1999 Edition

For the purposes of ORS 468.173 (Applicable percentage of certified cost of facility eligible for tax credit)(1), a facility may be certified under the 1999 edition of 468.155 (Definitions for ORS 468.155 to 468.190) to 468.190 (Allocation of costs to pollution control) if the facility was substantially completed on or before December 31, 2001, and an application was filed with the Department within two years after the date of substantial completion.
