Criminal Penalties

(1) Operating an AFH without a license is punishable as a Class C misdemeanor per ORS 443.991 (Penalties)(5).
(2) Refusing to allow access and inspection of a home by Department or LLA staff or state or local fire inspection is a Class B misdemeanor per ORS 443.991 (Penalties)(6).
(3) The Department may commence an action to enjoin operation of an AFH:
(a) When an AFH is operated without a valid license.
(b) After a notice of revocation or suspension has been given and a reasonable time for placement of individuals in other facilities has been allowed.
