Eligibility

(1) School districts are eligible for School Transportation grants.
(2) A school district may receive an award only for the following eligible transportation costs:
(a) For which the school district does not receive any amount in distributions from the State School Fund under ORS 327.013 (State School Fund distribution computations for school districts) or any amount related to transit activities, and
(b) That are incurred by the school district for the provision of transportation to students in grades 9 through 12 on:
(A) A school bus, as defined in ORS 801.460 (“School bus”); or
(B) A school activity vehicle, as defined in ORS 801.455 (“School activity vehicle”).
(3) School districts may transfer grant funds by contract with a public charter school or private alternative educational program for eligible transportation costs set forth in subsection (2).
