Determination of Need for an Order of Selection

(1)

The Program may implement an order of selection if it determines that it cannot provide the full range of vocational rehabilitation services to all eligible individuals, based on projected fiscal and personnel resources and the rehabilitation needs of individuals with significant disabilities in the state.

(2)

The Program shall determine whether an order of selection is necessary prior to the beginning of each fiscal year or during a fiscal year based on changed circumstances.

(3)

The Program shall consult with the State Rehabilitation Council regarding the administrative rules governing the order of selection and prior to making a determination to implement the order.
