Complaint Evaluation

(1)

“Complaint” means information provided by a person concerning possible violations of ORS Chapter 468 (Environmental Quality Generally) or 468B or any rule, order, or permit adopted thereunder and relating to the control and prevention of water pollution from a confined animal feeding operation as defined in OAR 603-074-0010 (Definitions).

(2)

If the department finds, upon investigation of the complaint, that the complaint was groundless and made for the purposes of harassing the operator, the department may refuse to consider future complaints made by the complainant. Such a determination may include an evaluation of:

(a)

Relationship between the operator and complainant;

(b)

Number and validity of previous complaints filed by complainant against the operator;

(c)

Frequency of complaints filed by complainant against the operator.
