(1)

Pursuant to ORS 477.225 (Establishment and change of forest protection districts), district boundaries may be changed only after a public hearing. A public hearing conducted for the purposes of amending OAR 629-041-0500 (Purpose) to 629-041-0575 (Western Lane Forest Protection District Boundary) shall be deemed to be the hearing required by ORS 477.225 (Establishment and change of forest protection districts).

(2)

District boundaries set forth in OAR 629-041-0500 (Purpose) to 629-041-0575 (Western Lane Forest Protection District Boundary):

(a)

Lie within the area surveyed from the Willamette Baseline and the Willamette Meridian.

(b)

Define the exterior boundary of the district.

(c)

Progress in a clockwise direction around the district.

Unless otherwise stated, all lines described in OAR 629-041-0500 (Purpose) to 629-041-0575 (Western Lane Forest Protection District Boundary) which are along an identified boundary or a special survey line are as those boundaries or special survey lines existed on the date they were incorporated into the rule. Examples include county boundaries and the McQuinn Line which defines a portion of the boundary of the Warm Springs Indian Reservation.

Where the words “east,” “north,” “south” and “west” are used in OAR 629-041-0500 (Purpose) to 629-041-0575 (Western Lane Forest Protection District Boundary) to describe a straight line, such lines shall be meant to include deviations created by section corners which do not exactly match or other similar situations.

(5)

If the name or identification of a feature used in OAR 629-041-0500 (Purpose) to 629-041-0575 (Western Lane Forest Protection District Boundary) is changed, the description of the district boundary shall remain valid.
