Modifications to Drilling Permits
(1)
Modification to a permit involving depth, casing, or location within the same drilling or spacing unit must be submitted on an application form provided by the department, along with the applicable fee. (2) A modification of location to a different drilling or spacing unit requires a new application and fee, and may constitute a significant modification for land use purposes.(3)
The Permittee may not transfer the permit without written approval from the department. The department may transfer a permit to a new owner or operator if the following items are provided to the department:(a)
A completed application signed by the original permittee and the new permittee;(b)
A bond or alternative form of security acceptable to the department in the name of the new permittee; and(c)
-A new organization report.(4)
Deepening: A permittee must obtain written approval from the department before a well may be drilled to a depth below the maximum depth specified in the permit. To obtain approval, the permittee must file a written application that describes the present condition of the well, including the complete casing record, and the proposed work, including the plan for sealing off any oil, gas, brine, or fresh-water strata to be found or expected to be found in the deepening, and the new proposed total depth. If the method set forth is satisfactory and the permittee is not in violation of ORS chapter 520, the board’s rules implementing that chapter or the orders of the board, the department, the department may approve a permit modification. The permittee may not begin the actual deepening of the well until the modified permit has been posted at the well location.
