Control of Disease Outbreaks in Captive Wildlife

(1)

Diseased captive wildlife may be an imminent danger to public, wildlife, domestic animals, or livestock health.

(2)

Upon determination that an outbreak of communicable disease among captive wildlife is an imminent danger to public, wildlife, domestic animals, or livestock health, the Department may order the holder to euthanize, confine or transfer, by a specified deadline, any or all wildlife they hold.

(3)

Failure by the holder to take action ordered by the Department pursuant to paragraph (2) may result in the Department or its agents entering the holder’s facility to confine, euthanize, or transfer diseased wildlife. The holder is liable for any costs the State of Oregon so incurs. The Department bears no liability for such actions.
