Time for Filing Protests or Requests for Hearing


(1)

Pursuant to the Model Rules of Procedure, a protest is timely filed only if:

(a)

The protest is filed by the applicable deadline as described in OAR 137-003-0520 (Filing and Providing Copies of Documents in Contested Case)(8); and

(b)

The protest includes any statutorily required fees.

(2)

Pursuant to the Model Rules of Procedure OAR 137-003-0520 (Filing and Providing Copies of Documents in Contested Case)(1), a request for hearing is considered filed only when actually received by the Department.

(3)

A person may not file a protest or request for hearing by electronic mail.
