Definitions Relevant to Division 108


For purposes of OAR 735-108-0000 (Lamps, Reflective Devices and Associated Equipment for Motor Vehicles) through 735-108-0110 (Mounting, Wiring and Aiming of Motorcycle Auxiliary Front Lamps), the following definitions shall apply:

(1)

Backup lamp in compliance with FMVSS 108 constitutes “back-up lights” for purposes of ORS 811.515 (When lights must be displayed), 816.110 (Back-up lights), and 816.350 (Prohibitions on number and kind of lights for certain vehicles).

(2)

Clearance lamps in compliance with FMVSS 108 constitutes “clearance lights” for purposes of ORS 811.515 (When lights must be displayed), 816.200 (Clearance lights), and 816.320 (Lighting equipment required for motor vehicles).

(3)

“FMVSS” means Federal Motor Vehicle Safety Standard.

(4)

Headlamps in compliance with FMVSS 108 constitutes “headlights” for purposes of ORS 811.515 (When lights must be displayed), 816.050 (Headlights), 816.320 (Lighting equipment required for motor vehicles), and 816.350 (Prohibitions on number and kind of lights for certain vehicles).

(5)

Identification lamps in compliance with FMVSS 108 constitutes “identification lights” for purposes of ORS 811.525 (Exemptions from requirements for use of lights), 816.210 (Identification lights), and 816.320 (Lighting equipment required for motor vehicles).

(6)

License plate lamp in compliance with FMVSS 108 constitutes “registration plate light” for purposes of ORS 816.090 (Registration plate lights), 816.320 (Lighting equipment required for motor vehicles), and 816.350 (Prohibitions on number and kind of lights for certain vehicles).

(7)

“Lights” means lamps as referenced in FMVSS and SAE standards.

(8)

Parking lamps in compliance with FMVSS 108 constitutes “parking lights” for purposes of ORS 811.515 (When lights must be displayed) and 816.130 (Parking lights).

(9)

Reflex reflectors, intermediate side reflex reflectors and retroreflective sheeting in compliance with FMVSS 108 constitutes “reflectors” for purposes of ORS 816.180 (Reflectors) and 816.320 (Lighting equipment required for motor vehicles).

(10)

“SAE” means Society of Automotive Engineers.

Side marker lamps and intermediate side marker lamps in compliance with FMVSS 108 constitutes “marker lights” for purposes of ORS 811.515 (When lights must be displayed), 816.190 (Marker lights), and 816.320 (Lighting equipment required for motor vehicles).

(12)

Stop lamps and high-mounted stoplamp in compliance with FMVSS 108 constitutes “brake lights” for purposes of ORS 811.395 (Appropriate signals for stopping, turning, changing lanes and decelerating), 816.100 (Brake lights) and 816.320 (Lighting equipment required for motor vehicles).

Taillamps in compliance with FMVSS 108 constitutes “taillights” for purposes of ORS 816.080 (Taillights) and 816.320 (Lighting equipment required for motor vehicles).

(14)

“Transportation Safety” means Transportation Safety Division of the Oregon Department of Transportation.

(15)

Turn signal lamps, turn signal operating unit and turn signal flasher unit in compliance with FMVSS 108 constitutes “turn signals” for purposes of ORS 811.395 (Appropriate signals for stopping, turning, changing lanes and decelerating), 811.515 (When lights must be displayed), 816.120 (Turn signals), 816.320 (Lighting equipment required for motor vehicles), and 816.350 (Prohibitions on number and kind of lights for certain vehicles).

Vehicular hazard warning lamps, signal operating unit and flasher unit in compliance with FMVSS 108 constitutes “hazard lights” for purposes of ORS 816.240 (Hazard lights) and 816.350 (Prohibitions on number and kind of lights for certain vehicles).
