Application Review and Approval

(1)

Upon receipt of an application the Department shall determine whether the proposed Project is eligible for Program Funds. Proposed Projects that meet the following criteria are eligible:

(a)

The applicant is a short line railroad;

(b)

The Project will not require or rely upon continuing subsidies from the Department; and

(c)

The applicant is current on all state and local taxes, fees and assessments.

(2)

If the Project is not eligible, the Department shall, within 30 days:

(a)

Reject the application; or

(b)

Require the applicant to submit additional information as may be necessary.
