Under Contract for the Construction of a New Dwelling

“Under contract for the construction of a new dwelling” as used in ORS 671.540 (Application of ORS 671.510 to 671.760)(1)(h) means a residential general contractor has agreed, pursuant to a written contract, to construct a new residential dwelling for the owner in a location on the property where a structure did not previously exist or the existing structure is completely demolished, including the foundation, and removed prior to the new construction. For the purposes of this rule, remodeling or modifying an existing structure is not considered construction of a new dwelling.
