Appeals of Termination of Exempt Status


(1)

When a termination is proposed under section (1) of this rule, the State Fire Marshal must give the affected jurisdiction written notice at least 30 days before a proposed termination becomes effective.

(2)

An affected jurisdiction may appeal in writing any refusal of the State Fire Marshal to grant an approval or a proposed termination.

(3)

Upon receipt of an appeal under section (3) of this rule, the State Fire Marshal must initiate an administrative appeals process. The process must conform to the contested case provisions of ORS Chapter 183 (Administrative Procedures Act).

(4)

The results of the appeals process conducted under section (4) of this rule must be final and thereafter not appealable.
