Reporting requirements

The Department of Consumer and Business Services shall develop by rule reporting requirements as necessary for the consistent and efficient implementation of ORS 743B.200 (Requirements for insurers offering managed health insurance), 743B.202 (Requirements for insurers offering managed health or preferred provider organization insurance), 743B.250 (Required notices to applicants and enrollees) and 743B.423 (Utilization review requirements for insurers offering health benefit plan). In order to minimize duplicative reporting requirements, the department shall accept copies of reports prepared for national accreditation organizations as sufficient to meet the reporting requirements developed pursuant to this section to the extent that the reports include the information required by the department pursuant to this section. Sec. 43. An insurer transacting insurance in this state may not consider any information collected and reported under section 40 of this 2020 special session Act to:

(1)

Deny, limit, cancel, rescind or refuse to renew a policy of insurance;

(2)

Establish premium rates for a policy of insurance; or

(3)
