URPTDA 9. Requirements


A transfer on death deed:


Except as provided otherwise in paragraph (b) of this subsection, must contain the essential elements and formalities of a properly recordable inter vivos deed;


Must state that the transfer to the designated beneficiary is to occur at the transferor’s death;


Must identify the designated beneficiary by name; and


Must be recorded before the transferor’s death in the deed records in the office of the county clerk for the county in which the property is located.


A beneficiary designation that identifies beneficiaries only as members of a class is void. [2011 c.212 §9]
