Presumptive Probation Sentences


(1)

Except as provided by OAR 213-009-0001 (Statutorily Mandated Imprisonment), or otherwise established by ORS 137.717 (Presumptive sentences for certain property offenders) or 137.719 (Presumptive life sentence for certain sex offenders upon third conviction), if the offense is classified in a grid block below the dispositional line, the presumptive sentence shall be:

(a)

A term of probation which may include custody and conditions of supervision; or

(b)

Straight jail subject to the limits in OAR 213-005-0013 (Jail as Part of Probation).

Each grid block below the dispositional line of the grid includes two components of a presumptive probationary sentence. The top number in each grid block is the number of sanction units that may be imposed as part of a presumptive probationary sentence. The bottom number in each grid block is the maximum number of sanction units that may be imposed as a jail term.
