Authority, Purpose and Policy

Authority: The authority for this rule is granted to the Director of the Department of Corrections in accordance with ORS 179.040 (General powers and duties), 179.473 (Transfers between institutions), 179.478 (Examination for intellectual disability), 179.479 (Conveyance of adults in custody from institution to physician or hospital for treatment), 179.495 (Disclosure of written accounts of adult in custody), 179.505 (Disclosure of written accounts by health care services provider), 423.020 (Department of Corrections), 423.030 (Department not limited by ORS 423.020), 423.075 (Director) and 2005 Or Laws, Ch 439.

Purpose: This rule prescribes procedures by which inmates of Department of Corrections facilities may be transferred to a state mental hospital listed in ORS 426.010 (State hospitals for persons with mental illness).

Policy: It is the policy of the Department of Corrections to establish procedures to provide for the best possible evaluation, treatment and return or release to inmates, to and from a state mental hospital in accordance with ORS 179.473 (Transfers between institutions), 179.478 (Examination for intellectual disability), 179.479 (Conveyance of adults in custody from institution to physician or hospital for treatment) and 2005 Oregon Laws, Ch 439.
