Licenses: Types of Licenses

General licenses provided in this division are granted as being effective without the filing of applications with the Authority or the issuance of licensing documents to particular persons, except Depleted Uranium subject to OAR 333-102-0106 (General Licenses — Depleted Uranium in Industrial Products and Devices), Measuring, Gauging, and Controlling devices subject to OAR 333-102-0115 (General Licenses — Radioactive Material Other than Source Material: Certain Measuring, Gauging and Controlling Devices), and In Vitro Clinical or Laboratory Testing subject to OAR 333-102-0130 (General Licenses — Radioactive Material Other than Source Material: General License for Use of Radioactive Material for Certain In Vitro Clinical or Laboratory Testing).(2)
Specific licenses require the submission of an application to the Authority and the issuance of a specific licensing document by the Authority. The licensee is subject to all applicable portions of these rules as well as any limitations specified in the licensing document. Specific licenses are issued to named persons upon applications filed pursuant to OAR 333-102-0200 (General Licenses — Radioactive Material Other than Source Material: General Requirements for the Issuance of Specific Licenses) and divisions 105, 113, 115, 116, 117, and 121 of this chapter.(3)
General licenses granted by OAR 333-102-0101 (General Licenses — Small Quantities of Source Material), 333-102-0106 (General Licenses — Depleted Uranium in Industrial Products and Devices), 333-102-0115 (General Licenses — Radioactive Material Other than Source Material: Certain Measuring, Gauging and Controlling Devices), and 333-102-0130 (General Licenses — Radioactive Material Other than Source Material: General License for Use of Radioactive Material for Certain In Vitro Clinical or Laboratory Testing) require the submission of an application to the Authority for registration pursuant to 333-101-0007 (Application for General License Registration for Radioactive Materials Gauges, In Vitro Testing, Source Material, Reference and Calibration Sources, and Reciprocal Recognition of Specific Radioactive Materials License), payment of a fee in accordance with 333-103-0015 (Annual Registration Fee for General Licenses and Devices), and the issuance of a registration (licensing document or general license acknowledgment) by the Authority.(4)
General licenses are subject to OAR 333-100-0005 (Definitions) (Definitions), 333-100-0025 (Exemptions) (Exemptions), 333-100-0030 (Additional Requirements) (Additional Requirements), 333-100-0055 (Records) (Records), 333-100-0060 (Inspections)(1) and 333-100-0060 (Inspections)(2) (Inspections), 333-100-0065 (Tests) (Tests), 333-102-0305 (Special Requirement for a Specific License to Manufacture, Assemble, Repair or Distribute Commodities, Products or Devices Which Contain Radioactive Material: Specific Terms and Conditions of License)(1) through 333-102-0305 (Special Requirement for a Specific License to Manufacture, Assemble, Repair or Distribute Commodities, Products or Devices Which Contain Radioactive Material: Specific Terms and Conditions of License)(8) (Terms and Conditions of Licenses), 333-102-0330 (Special Requirement for a Specific License to Manufacture, Assemble, Repair or Distribute Commodities, Products or Devices Which Contain Radioactive Material: Transfer of Material) (Transfers), 333-102-0335 (Special Requirement for a Specific License to Manufacture, Assemble, Repair or Distribute Commodities, Products or Devices Which Contain Radioactive Material: Modification, Revocation and Termination of Licenses) (Modification, Revocation, and Termination of Licenses), and divisions 103, 111, 118, and 120 of this chapter unless indicated otherwise in the language of the general license.(5)
Any record required by this division must be legible throughout the retention period specified by each Authority rule. The record may be the original or a reproduced copy or a microform provided that the copy or microform is authenticated by authorized personnel and that the microform is capable of producing a clear copy throughout the required retention period. The record may also be stored in electronic media with the capability for producing legible, accurate, and complete records during the required retention period. Records such as letters, drawings, specifications, must include all pertinent information such as letters, stamps, initials, and signatures. The licensee must maintain adequate safeguards against tampering with and loss of records.
