Definitions


(1)

“Community Center” mean facilities operated by non-profit community-based organizations for the provision of recreational, social or educational service to the general public.

(2)

“Department” means the Employment Department.

(3)

“Dependent” means:

(a)

An individual who has not attained the age of 17 years;

(b)

An individual who has attained the age of 55 years; or

(c)

A person with a developmental disability.

(4)

“Developmental Disability” means a severe chronic disability which:

(a)

Is attributable to a mental or physical impairment or combination of physical and mental impairments;

(b)

Is manifested before the person attains age 22;

(c)

Is likely to continue indefinitely;

(d)

Results in substantial functional limitations in three or more of the following areas of major life activity:

(A)

Self-care;

(B)

Receptive and expressive language;

(C)

Learning;

(D)

Mobility;

(E)

Self-direction;

(F)

Capacity for independent living; and

(G)

Economic self-sufficiency.

(e)

Reflects the person’s need for a combination and sequence of special, interdisciplinary, or generic care, treatment, or other services which are individually planned and coordinated.

(5)

“Eligible Activities” mean the planning and development activities allowed under these rules.

(6)

“Local Education Agency” means a public board of education or other public authority legally constituted within the State for either administrative control or direction of; or to perform a service function for, public elementary or secondary schools as established in the State of Oregon.

(7)

“Administrator” means the Administrator of the Child Care Division of the Employment Department.

(8)

“School-Age Children” means children aged five through thirteen.

(9)

“School Facilities” means classroom and related facilities used for the provision of education.

(10)

“Subcontractor” means local public or private, non-profit entities with which Child Care Division subcontracts for operation of the Dependent Care Planning and Development Program.
