Treaty Indian Fishery Definitions


In addition to the definitions provided in the commercial fishing laws and other rules of the Department, the following definitions shall apply to the Treaty Indian Fishery:

(1)

“Commission” means the Oregon Fish and Wildlife Commission.

(2)

“Department” means the Oregon Department of Fish and Wildlife.

(3)

“Director” means the Director of the Oregon Department of Fish and Wildlife.

(4)

“Fishway” means any structure or facility made to facilitate or provide passage for fish over a natural or artificial barrier or obstruction.

(5)

“Subsistence fishing” means taking fish for Indians’ personal use, including the sale or exchange with other treaty Indians, but not sale or trade with non-Indians.
