Sale of Wildlife


(1)

Except as provided in these rules and other rules of the commission, no person shall sell, purchase, exchange or offer to sell, purchase or exchange any wildlife (including game fish in the aquaria trade).

(2)

Except as otherwise provided in this section, kingsnakes (Lampropeltis getula and L. zonata) and gopher (bull) snakes (Pituophis catenifer) that are morphologically similar to native species may be possessed, transported, sold, purchased, exchanged or offered for sale, purchase or exchange if the animals were legally acquired and bred in captivity. However, nothing in these rules authorizes the:

(a)

Capture, possession, transportation, sale, purchase, exchange, or offer of sale, purchase or exchange of any wild native kingsnake or its offspring; or

(b)

Sale, purchase, exchange, or offer of sale, purchase or exchange of any wild gopher snake or its progeny.

(3)

When any nonnative wildlife species is offered for sale, trade or barter, the person making the offer shall display (until the transaction is completed) both the species’ common name(s) and scientific taxonomic name (genus, species and subspecies (if appropriate)), as listed in the reference material in 635-056-0000 (Purpose and General Information)(2) of these rules. The common name(s) and scientific name shall be posted at or on the cage, tank, or pen where the wildlife are being held or displayed.
