Pre-existing Condition Exclusions; Health Insurance


With respect to health insurance policies:

(1)

Asymptomatic HIV infection shall not be considered a preexisting condition with respect to subsequent claims related to AIDS or ARC. “Asymptomatic HIV infection” is that which is identified solely through use of a test for a virus or antibodies to the virus.

(2)

The period of exclusion for HIV infection claims, when physical symptoms were present before the coverage date, shall be no longer than that for other pre-existing diseases.
