Timely Notice of Denial of Charges to Provider


(1)

This rule is adopted under the authority of ORS 731.244 (Rules) for the purpose of implementing ORS 742.524 (Contents of personal injury protection benefits).

(2)

When an insurer is required to provide notice of a denial of charges within 60 days of receipt, it shall be presumed that the provider has received the denial within three days after it is served by mail.

(3)

If an insurer serves the denial electronically or by fax, it shall be presumed that the provider has received it on the day it is transmitted.
