Leave for Victims of Domestic Violence, Harassment, Sexual Assault or Stalking: Purpose and Scope

The Civil Rights Division of the Bureau of Labor and Industries (“division”) enforces ORS 659A.270 (Definitions for ORS 659A.270 to 659A.285) to 659A.285 (Use of paid leave) which require certain employers to grant leave for victims of domestic violence, harassment, sexual assault or stalking. These rules implement and interpret 659A.270 (Definitions for ORS 659A.270 to 659A.285) to 659A285.

The division also enforces ORS 659A.290 (Prohibited conduct by employer), requiring all employers to provide reasonable safety accommodation (including use of available paid leave from employment) for, and prohibiting discrimination or retaliation against, victims of domestic violence, harassment, sexual assault or stalking. ORS 659A.190 (Definitions for ORS 659A.190 to 659A.198) to 659A.198 (Use of paid leave) provide for leave for crime victims to attend criminal proceedings. The division does not have authority to enforce ORS 659A.190 (Definitions for ORS 659A.190 to 659A.198) to 659A.198 (Use of paid leave).
