Withdrawal from sale of Elliott State Forest


Any lands in the national forests on February 25, 1913, selected by, and patented to, the State of Oregon, for the purpose of establishing a state forest, hereby are withdrawn from sale except as provided in ORS 530.510 (Exchanges of land). The state forest shall be known as the Elliott State Forest. [1957 c.240 §1]

Notes of Decisions

In addition to applying to patented lands, this section applies to in-lieu lands obtained from United States through clear lists. Cascadia Wildlands v. Department of State Lands, 293 Or App 127, 427 P3d 1091 (2018), aff’d 365 Or 750, 452 P3d 938 (2019)

Withdrawal from sale of Elliott State Forest by this section is consistent with Article VIII, section 5 of Oregon Constitution, because constitution subjects State Land Board’s management of common school lands to legislative direction.
