Confidentiality of information

(1)

Any information that the Oregon State Board of Nursing obtains pursuant to ORS 678.021 (License required to practice nursing), 678.111 (Causes for denial, revocation or suspension of license or probation, reprimand or censure of licensee), 678.113 (When evaluation of mental or physical condition, demonstration of competency or evidence of continuing education may be required), 678.123 (Prohibited acts), 678.135 (Duty to report violations) or 678.442 (Certification of nursing assistants) is confidential as provided under ORS 676.175 (Complaints and investigations confidential).

Upon receipt of a complaint under ORS 678.010 (Definitions for ORS 678.010 to 678.410) to 678.410 (Fees) or 678.442 (Certification of nursing assistants), the Oregon State Board of Nursing shall conduct an investigation as described under ORS 676.165 (Complaint investigation).

Any person, facility, licensee or association that reports or provides information to the board under ORS 678.021 (License required to practice nursing), 678.111 (Causes for denial, revocation or suspension of license or probation, reprimand or censure of licensee), 678.113 (When evaluation of mental or physical condition, demonstration of competency or evidence of continuing education may be required), 678.123 (Prohibited acts), 678.135 (Duty to report violations) or 678.442 (Certification of nursing assistants) in good faith shall not be subject to an action for civil damages as a result thereof.
