The Oregon State Board of Nursing may establish and collect fees necessary to carry out the provisions of ORS 678.010 (Definitions for ORS 678.010 to 678.410) to 678.448 (Use of titles “Certified Nursing Assistant,” “nursing assistant,” “nurse aide” or “CNA”).


Fees are nonrefundable.


(a) The board shall obtain approval from the Oregon Department of Administrative Services and submit a report to the Emergency Board prior to establishing fees under this section.


A fee established and collected under this section may not exceed the cost of administering a regulatory program for which the fee is established and collected, as authorized by the Legislative Assembly within the Oregon State Board of Nursing budget, subject to modification by the Emergency Board.


If federal or other funds are available to offset costs of administering the program, fees shall be established based on net costs to the state but may not exceed $75 per biennium for a nursing assistant certification.
