Regulation of unmanned aircraft systems in parks owned by local government

(1)

Notwithstanding ORS 837.385 (Preemption of local laws regulating unmanned aircraft systems), a local government, as defined in ORS 174.116 (“Local government” and “local service district” defined), may enact an ordinance or resolution prohibiting or regulating the takeoff and landing of unmanned aircraft systems in parks owned by the local government.

(2)

An ordinance enacted under subsection (1) of this section must:

(a)

Allow utility providers a reasonable ability to use unmanned aircraft systems in parks for the purpose of inspecting utility lines.

(b)

Allow public bodies to use unmanned aircraft systems in parks for emergency operations.

(c)

Provide for an affirmative defense to a charge or claim of violation of the ordinance when a person performs an emergency landing of an unmanned aircraft system in a park in the absence of an equally safe alternative. [2023 c.115 §2]
