OAR 137-048-0130 (Applicable Selection Procedures; Pricing Information; Disclosure of Proposals; Conflicts of Interest)(2)(b) and (c) are clarified as follows:

(a)

Authorized Agencies must follow ORS 279C.120 (Selection procedure for related services) and may not select a Consultant pursuant to 279B and related OAR 137-047.

(b)

When selecting a Consultant, Authorized Agencies must follow the applicable selection procedure under OAR 137-048-0200 (Direct Appointment Procedure) (Direct Appointment Procedure), 137-048-0210 (Informal Selection Procedure) (Informal Selection Procedure) or 137-048-0220 (Formal Selection Procedure) (Formal Selection Procedure).

(c)

Authorized Agencies may incorporate into the selection procedure described in subsection (2)(b) one or more specific procedures found in competitive sealed bidding and competitive sealed proposals as described in ORS 279B.055 (Competitive sealed bidding), 279B.060 (Competitive sealed proposals), OAR 125-247-0255 (Competitive Sealed Bidding), and 125-247-0260 (Competitive Sealed Proposals). Non-procedural requirements of ORS 279B and OAR 125-247, like highest standards and good cause, do not apply to the selection procedure.
