Application

This rule applies to decisions concerning wetland resource designations and analysis of alternatives made after the local government sponsoring the Wetland Conservation Plan (WCP) has:(a)
Defined the WCP area;(b)
Completed the required Local Wetlands Inventory (LWI) according to the criteria of OAR 141-086-0180 (Purpose) to 141-086-0240 (Landowner Notification);(c)
Completed the required wetland function and value assessments using an assessment methodology acceptable to the Division; and(d)
Developed WCP Goals for the planning area that consider the legislative findings in ORS 196.668 (Legislative findings).(2)
Consistent with ORS 527.722 (Restrictions on local government adoption of rules regulating forest operations) of the Forest Practices Act, this rule does not apply to forest practices as defined in ORS 527.620 (Definitions for ORS 527.610 to 527.770) in areas regulated by the Forest Practices Act (ORS 527.610 (Short title) to 527.770 (Good faith compliance with best management practices not violation of water quality standards), 527.990 (Criminal penalties)(1) and 527.992 (Civil penalties)).
