Types of Crimes Relevant to a Fitness Determination

(1)

Crimes Relevant to a Fitness Determination.

(a)

All felonies;

(b)

All misdemeanors;

(c)

Any United States Military crime or international crime;

(d)

Any civil restraining order entered for spousal abuse, domestic violence, harassment, or stalking.

(2)

Evaluation of Crimes. OYA must evaluate a crime on the basis of the laws of the jurisdiction in which the crime or offense occurred.
