Notice Situation; Removing an Individual From a Benefit Group (REF, REFM, SNAP, TANF) or Need Group (ERDC)


(1)

To remove an individual from a benefit group (see OAR 461-110-0750 (Benefit Group)), the following notices are used:

(a)

A continuing benefit decision notice (see OAR 461-001-0000 (Definitions for Chapter 461)) is used when the removal is based on information reported on the Interim Change Report form.

(b)

A timely continuing benefit decision notice (see OAR 461-001-0000 (Definitions for Chapter 461)) is used when the removal is not based on the Interim Change Report form.

(2)

In the ERDC program, the Department sends a timely continuing benefit decision notice to remove an individual from the need group (see OAR 461-110-0630 (Need Group)).

(3)

In the TANF program, if a child (see OAR 461-001-0000 (Definitions for Chapter 461)) is removed from the benefit group as a result of a court order or a voluntary placement in foster care by the child’s caretaker relative (see OAR 461-001-0000 (Definitions for Chapter 461)), a basic decision notice (see OAR 461-001-0000 (Definitions for Chapter 461)) is used.
