Purpose

The purpose of these rules is to further the State of Oregon’s Wildlife Policy contained in ORS 496.012 (Wildlife policy) and 496.138 (Commission policies and programs) and the Food Fish Management Policy contained in 506.109 (Food fish management policy) by applying consistent standards for reviewing and issuing in-water blasting permits as required by 509.140 (Placing explosives or harmful substances in waters in course of lawful work). These rules establish procedures that the Department will use to review and make decisions on applications for in-water blasting activities, including any permit conditions necessary to prevent injury to fish, wildlife, and their habitat.
