The Department may charge a fee for acquiring criminal offender information for use in making a fitness determination. The fee shall not exceed the actual cost of aquiring criminal offender information on the subject individual.

The Department shall not charge a fee if the subject individual is a Department employee, a Department volunteer, or an applicant for employment or a volunteer position with the Department.
