ORS 180.205
Tobacco Enforcement Fund
(1)
The Tobacco Enforcement Fund is established separate and distinct from the General Fund. The Tobacco Enforcement Fund shall consist of:(a)
Moneys deposited into the fund under ORS 180.450 (Judicial review), 180.451 (Civil remedies for violation of ORS 180.441) and 180.491 (Judicial review); and(b)
Moneys transferred to the fund under ORS 293.537 (Tobacco Settlement Funds Account).(2)
Moneys in the Tobacco Enforcement Fund are continuously appropriated to the Department of Justice for the purpose of enforcing the provisions of ORS 180.400 (Legislative findings) to 180.455 (Revocation or suspension of distributor license), 180.465 (Legislative findings) to 180.494 (Revocation or suspension of distributor license), 323.106 (Certification of intent to comply with reporting, recordkeeping and directory participation requirements), 323.806 (Required actions by manufacturers) and 323.810 (Definitions for ORS 323.810 to 323.816) to 323.816 (Required actions by manufacturer). Moneys in the fund are not subject to allotment under ORS 291.234 (Department to make allotments to state officers and agencies of appropriations and funds) to 291.260 (Approving, modifying or disapproving requests and budgets to be submitted to the federal government).
