Deduction by employees of public universities for payment to nonprofit organization

  • approval by governing board

(1)

As used in this section:

(a)

“Employee” means officers, faculty, teachers, instructors and other employees of a public university listed in ORS 352.002 (Public universities).

(b)

“Nonprofit organization” means an organization described in section 501(c)(3) of the Internal Revenue Code that is exempt from income tax under section 501(a) of the Internal Revenue Code.

(2)

The governing board of a public university listed in ORS 352.002 (Public universities) may approve a written request made by the university or office, department or activity under the governing board’s jurisdiction, in which an employee of the university or office, department or activity may designate an amount from the salary or wages of the employee for payment to a qualifying nonprofit organization. A request made under this section must identify the nonprofit organization to whom payments would be made.

Upon written approval and a written request of an employee of the public university or office, department or activity to which the approval applies, the state official within the public university listed in ORS 352.002 (Public universities) authorized to disburse funds in payment of salaries or wages shall deduct from the salary or wages of the employee the amount of money designated by the employee for payment to the nonprofit organization.

(4)

The moneys deducted from the salaries or wages under subsection (3) of this section shall be paid over promptly to the nonprofit organization.

(5)

The governing board of a public university listed in ORS 352.002 (Public universities) shall prescribe procedures for determining whether an organization qualifies as a nonprofit organization under this section. [2009 c.251 §1; 2011 c.637 §100; 2013 c.768 §131; 2015 c.767 §95]
