Department to ensure compliance

(1)
The Oregon Department of Emergency Management may institute proceedings against a public or private safety agency, a 9-1-1 jurisdiction or other person to compel compliance with or to restrain further violation of ORS 305.823 (Local government tax on telephone services prohibited) and 403.105 (Definitions for ORS 305.823 and 403.105 to 403.250) to 403.250 (Primary public safety answering points) or rules adopted pursuant to ORS 403.120 (Oregon Department of Emergency Management duties and powers).(2)
Proceedings authorized by subsection (1) of this section may be instituted without official notice, hearing or order provided in ORS chapter 183. However, proceedings brought against a telecommunications utility must be brought before the Public Utility Commission as provided by ORS chapter 756. [Formerly 401.790; 2021 c.539 §65](2)
