The Department of Environmental Quality shall declare a ground water management area if, as a result of information provided to the department or from its statewide monitoring and assessment activities under ORS 468B.190 (Ground water monitoring and assessment), the department confirms that, as a result of suspected nonpoint source activities, there is present in the ground water:
A declaration under subsection (1) of this section shall identify the substances detected in the ground water and all ground water aquifers that may be affected.

Before declaring a ground water management area under subsections (1) and (2) of this section, the agency shall have a second laboratory confirm the results that cause the agency to make the declaration. [Formerly 468.698]Note: See note under 468B.150 (Definitions for ORS 468B).
