Employer Responsibilities
(1)
The owner of any business or entity that employs or utilizes at least one individual whose primary responsibilities include providing private security services:(a)
Must designate an individual to perform the duties of an executive manager at all times as described in OAR 259-060-0130 (Private Security Executive Manager and Supervisory Manager Licensure and Responsibilities). An employer may obtain licensure for more than one executive manager.(b)
Is prohibited from using a name that implies that the employer’s business or entity is, or is affiliated with, an existing law enforcement unit or public safety agency as defined in ORS 181A.355 (Definitions for ORS 181A.355 to 181A.670), the organized militia as described in ORS 396.105 (Militia comprised of organized and unorganized militia), the Armed Forces of the United States, a federal law enforcement agency or a federal intelligence agency. Employers operating under a name prior to July 1, 2016 are exempt from this restriction for as long as the business or entity is owned by the same person.(2)
For the purpose of these administrative rules, these provisions apply to any business, employer or entity that provides private security services within this state, regardless of whether the business, employer or entity is located in or out of this state.(3)
Violation of these rules may result in denial or revocation of private security certification or licensure as prescribed in OAR 259-060-0300 (Grounds to Deny, Revoke, Suspend or Refuse to Renew Alarm Monitor Professional Certification), OAR 259-060-0310 (Grounds to Deny, Revoke, Suspend or Refuse to Renew Unarmed Private Security Professional Certification and Event and Entertainment Private Security Professional Certification) and OAR 259-060-0320 (Grounds to Deny, Revoke, Suspend or Refuse to Renew Armed Private Security Professional Certification, Private Security Instructor Certification, and Executive or Supervisory Manager Licensure), and civil penalties as prescribed in OAR 259-060-0450 (Compliance).
