Incapable of Work for the Purpose of Extending the Base Year

(1)

As used in ORS 657.170 (Extending base year), “incapable of work” means inability to engage in any gainful occupation solely because of physical or mental defect, disease or injury as verified in writing by a licensed medical or therapeutic practitioner, or other evidence satisfactory to the Director.

(2)

For purposes of applying ORS 657.170 (Extending base year)(2), where the date of the injury and the date on which claimant became temporarily totally disabled are not the same, the three-year time period for seeking a base year extension shall begin at the start of the claimant’s period of temporary total disability, not on the date of the injury.
