Entry upon private premises authorized

Personnel of the Department of Environmental Quality or a local health department, authorized environmental health specialists or other authorized personnel of a city or county may enter upon the premises of any person regulated under ORS 459.005 (Definitions for ORS 459) to 459.105 (Regulations on use of disposal sites), 459.205 (Permit required) to 459.385 (Entry upon private premises authorized), 466.005 (Definitions for ORS 453) to 466.385 (Amendment of comprehensive plan and land use regulations) and 466.992 (Civil penalties for damage to wildlife resulting from contamination of food or water supply) or under regulations adopted pursuant to ORS 450.075 (Powers of sanitary district), 450.810 (Board may adopt and enforce ordinances for sanitary purposes), 450.820 (Authority may maintain garbage collection system and engage in insect control activities) and 451.570 (Regulations for sewage disposal, solid waste disposal, street cleaning and other authorized purposes), at reasonable times, to determine compliance with and to enforce ORS 450.075 (Powers of sanitary district), 450.810 (Board may adopt and enforce ordinances for sanitary purposes), 450.820 (Authority may maintain garbage collection system and engage in insect control activities), 451.570 (Regulations for sewage disposal, solid waste disposal, street cleaning and other authorized purposes), 459.005 (Definitions for ORS 459) to 459.105 (Regulations on use of disposal sites), 459.205 (Permit required) to 459.385 (Entry upon private premises authorized), 466.005 (Definitions for ORS 453) to 466.385 (Amendment of comprehensive plan and land use regulations) and 466.992 (Civil penalties for damage to wildlife resulting from contamination of food or water supply) and any rules or regulations adopted pursuant thereto. The department shall also have access to any pertinent records, including but not limited to blueprints, operation and maintenance records and logs, operating rules and procedures. As used in this section, “pertinent records” does not include financial information unless otherwise authorized by law.
