Criminal penalties
(1)
Penalties provided in this section are in addition to and not in lieu of any other remedy specified in ORS 459.005 (Definitions for ORS 459.005 to 459.437, 459.705 to 459.790 and 459A.005 to 459A.665) to 459.105 (Regulations on use of disposal sites), 459.205 (Permit required) to 459.385 (Entry upon private premises authorized), 466.005 (Definitions for ORS 453.635 and 466.005 to 466.385) to 466.385 (Amendment of comprehensive plan and land use regulations) or 466.992 (Civil penalties for damage to wildlife resulting from contamination of food or water supply).(2)
Subject to ORS 153.022 (Authority of agency to specify rule violation as particular level of violation), violation by any person of a provision of ORS 466.605 (Definitions for ORS 466.605 to 466.680) to 466.680 (Responsibility for expenses of cleanup) or of any rule or order entered or adopted under ORS 466.605 (Definitions for ORS 466.605 to 466.680) to 466.680 (Responsibility for expenses of cleanup) is a Class A misdemeanor. Notwithstanding ORS 161.635 (Fines for misdemeanors), the maximum fine for a violation is $25,000. Each day of violation shall be considered a separate offense.(3)
Subject to ORS 153.022 (Authority of agency to specify rule violation as particular level of violation), any person who knowingly violates any provision of ORS 466.706 (Definitions for ORS 466.706 to 466.882 and 466.994) to 466.882 (Rules) and 466.994 (Civil penalties for violations of underground storage tank regulations) or the rules adopted under ORS 466.706 (Definitions for ORS 466.706 to 466.882 and 466.994) to 466.882 (Rules) and 466.994 (Civil penalties for violations of underground storage tank regulations) commits a Class A misdemeanor. Notwithstanding ORS 161.635 (Fines for misdemeanors), the maximum fine for a violation is $25,000. Each day of violation shall be deemed a separate offense.(4)
Subject to ORS 153.022 (Authority of agency to specify rule violation as particular level of violation), any person who knowingly violates any provision of ORS 465.200 (Definitions for ORS 465.200 to 465.545) to 465.545 (Suspension of dry cleaning fees) or any rule or order adopted or issued under ORS 465.200 (Definitions for ORS 465.200 to 465.545) to 465.545 (Suspension of dry cleaning fees) commits a Class A misdemeanor. Notwithstanding ORS 161.635 (Fines for misdemeanors), the maximum fine for a violation is $25,000. Each day of violation shall be deemed a separate offense.(5)
Notwithstanding ORS 161.655 (Fines for corporations), if a person incurring a fine under this section is a corporation, the corporation shall pay the fine provided for under this section.
