Violations

(1)
If no warning sign is posted:(a)
The Oregon Liquor and Cannabis Commission shall furnish a warning sign.(b)
The retailer shall have five days from the receipt of the warning sign to post it appropriately.(2)
If there is a violation of this section or of ORS 471.551 (Warning signs required), the violator shall be subject to:(a)
A written warning from the commission for the first violation accompanied by a copy of the sign.(b)
A civil penalty of not to exceed $25 payable to the commission for a second violation.(c)
A civil penalty of not to exceed $25 for the third and subsequent violations for each day the sign is not posted.(3)
The civil penalty imposed under subsection (2) of this section shall be separate from any other sanction or penalty imposed by the commission and shall not be used in any progressive violation schedule.(4)
The penalty provided by this section shall be the sole penalty for violation of this section or ORS 471.551 (Warning signs required) or the rules adopted under section 1, chapter 324, Oregon Laws 1991.(5)
Violation of this section or ORS 471.551 (Warning signs required) or the rules adopted under section 1, chapter 324, Oregon Laws 1991, shall not be grounds for refusal to issue a license, cancellation of a license or suspension of a license issued under this chapter.(6)
Nothing in this section or ORS 471.551 (Warning signs required) or the rules adopted under section 1, chapter 324, Oregon Laws 1991, creates any new cause of action or any private right of any person. [1991 c.324 §5; 2011 c.597 §213; 2021 c.351 §121]
