Definitions for ORS 164


As used in ORS 164.061 (Sentence for aggravated theft in the first degree when victim 65 years of age or older), 475.907 (Sentencing for unlawful delivery of cocaine, methamphetamine, heroin or ecstasy to minors), 475.924 (Definitions for ORS 164) and 475.925 (Sentences for certain controlled substance offenses):

(1)

“Controlled substance” means:

(a)

Cocaine;

(b)

Methamphetamine;

(c)

Heroin; or

(d)

Ecstasy.

(2)

“Ecstasy” means:

(a)

3,4-methylenedioxymethamphetamine;

(b)

3,4-methylenedioxyamphetamine; or

(c)

3,4-methylenedioxy-N-ethylamphetamine.

(3)

“Mixture or substance” means any mixture or substance, whether or not the mixture or substance is in an ingestible or marketable form at the time of the offense. [2008 c.14 §5]
