ORS 97.849
Authority of Department of Consumer and Business Services to take action regarding endowment care cemetery


(1)

The Department of Consumer and Business Services may, if a cemetery authority responsible for an endowment care cemetery violates a provision of ORS 97.810 (Endowment care and nonendowed care cemeteries) to 97.920 (Judgment declaring nuisance, authorizing abatement and creating and foreclosing lien) with respect to the endowment care cemetery:

(a)

Issue an emergency order to suspend or restrict the operations of an endowment care cemetery; or

(b)

Take other action deemed necessary by the Director of the Department of Consumer and Business Services.

(2)

After taking an action described in subsection (1) of this section, the director shall promptly provide opportunity for a hearing pursuant to ORS chapter 183.

(3)

An emergency order is:

(a)

Effective upon issuance;

(b)

Reviewable as provided in ORS 183.480 (Judicial review of agency orders); and

(c)

Enforceable in the courts of this state. [2019 c.8 §2]
Note: 97.849 (Authority of Department of Consumer and Business Services to take action regarding endowment care cemetery) was added to and made a part of 97.810 (Endowment care and nonendowed care cemeteries) to 97.920 (Judgment declaring nuisance, authorizing abatement and creating and foreclosing lien) by legislative action but was not added to any smaller series therein.
