The Board will accept amicus curiae briefs that are received by the Board (and served on all parties) within 21 days after objections to the Recommended Order are filed with the Board, or, when an appellate court has remanded the matter to the Board, within 14 days of the appellate judgment. The Board may extend the filing date at its discretion.
An amicus brief must be typewritten with double spacing on letter-sized paper and no more than 20 pages.
Amicus curiae shall not be allowed to orally argue the case, unless authorized by the Board.
The Board, at its discretion, may invite the filing of amicus curiae briefs. In such circumstances, the Board will set a briefing schedule.
