Authority, Purpose, and Policy


(1)

Authority: The authority for this rule is granted to the Director of the Department of Corrections in accordance with ORS 179.040 (General powers and duties), 421.142 (Manufacture and sale of handiwork), 423.020 (Department of Corrections), 423.030 (Department not limited by ORS 423.020), and 423.075 (Director).

(2)

Purpose: To afford constructive utilization of leisure time providing a positive learning experience and potential for earning funds for those inmates in participating institutions/facilities.

(3)

Policy:

(a)

It is the policy of the Department of Corrections that selected inmates within Department of Corrections participating facilities may be permitted to manufacture small items of authorized handiwork, and to sell or otherwise dispose of these through approved channels;

(b)

It is the policy that the price of handiwork products to Department of Corrections staff will be the same as the public price. ORS 421.405 (Use of labor of adults in custody for benefit of officials prohibited) prohibits offices and employees of the state from receiving the use or profit of the labor or services of any inmate.
